Do I Need a Permit?

You generally won’t need a permit if your development activities avoid gopher tortoise burrows and the tortoises themselves by at least 25 feet. This includes tasks like vegetation clearing, grading, construction, or using heavy equipment such as bulldozers. Routine yard maintenance and landscaping that doesn’t harm the tortoises or disturb their burrows also do not require a permit.

 

However, if your activities may affect the burrows or tortoises, or if you're unsure about the distance or potential impact, it's advisable to consult with local authorities or wildlife agencies to ensure you're following any necessary regulations.

 

Regardless of whether a permit is needed, temporary exclusion fencing (such as black fabric or "silt fencing" commonly used on construction sites) should be installed to protect tortoises and their burrows that are not directly affected. This fencing helps prevent tortoises from entering areas where construction activities are taking place.

How do I know if I have gopher tortoises on my property?

Gopher tortoise burrows are categorized as either potentially occupied or abandoned. A permit is necessary if a potentially occupied burrow will be disturbed or damaged in any way.
